These Terms of Hire set out the standard conditions under which Hire Shop (Birmingham) Ltd provides equipment and consumables for hire or sale. By hiring or purchasing from us, you agree to be bound by these Terms.

 

1. Introduction
  • This agreement is between you (the Customer) and us (Hire Shop Birmingham Ltd) for the hire of equipment.

  • The equipment is hired to you only. You must not lend, sell, hire, or transfer the equipment to anyone else.

  • We will agree with you:

    • the details of the equipment;

    • the hire period;

    • the deposit and hire charges;

    • any delivery, collection, or service charges; and

    • the site address (if relevant).

  • Customers hiring equipment for business use are bound by all conditions. Customers hiring for private/domestic use have additional protections set out in section 16 (“Hire as a Consumer”).

  • You must be at least 18 years old to hire equipment from us. We cannot hire to anyone under the age of 18.

 

2. Collection & Return
  • Unless otherwise agreed, you are responsible for collecting equipment from our depot and returning it at the end of the hire period.

  • Equipment is your responsibility once signed out to you, and remains so until our staff sign it back in.

 

3. Delivery, Collection & Services
  • If we deliver, the equipment becomes your responsibility once unloaded on site.

  • Delivery, collection, waiting time, or other site services are charged in addition to hire fees.

  • You are responsible for ensuring safe access and a suitable site for delivery/collection.

  • We will make every effort to meet agreed times but accept no liability for delays outside our control.

  • You are responsible for arranging the collection of hired equipment by contacting us via telephone.

 

4. Condition on Return
  • Equipment must be returned (or made available for collection) clean, undamaged, and in good working order.

  • You are responsible for reasonable costs of repair or cleaning if this condition is not met.

 

5. Site Access & Safety
  • You must provide safe access and facilities for delivery/collection.

  • While on your site, our staff are under your direction and must be able to work safely.

  • You are responsible for any damage or injury caused on site, unless due to our negligence.

 

6. Safe Use of Equipment
  • You must use the equipment safely, correctly, and responsibly, as if it were your own.

  • Only competent, trained, and supervised operators should use the equipment.

  • You must follow all instructions provided and carry out routine safety checks.

  • If damage or injury occurs, or the equipment is damaged, you must stop using it immediately and inform us.

 

7. Maintenance
  • You are responsible for routine maintenance such as lubrication and refuelling with the correct fuel/voltage.

  • We will inform you if servicing is due and will carry it out.

 

8. Breakdown
  • You must notify us immediately if equipment breaks down.

  • Hire charges remain payable until we are notified.

  • We may reduce hire charges for idle time, except where the breakdown is due to misuse, negligence, or failure to follow instructions.

 

9. Protection of Equipment
  • Equipment must remain in your possession and control and may not be moved off site without permission.

  • You must take all reasonable steps to secure and protect the equipment.

  • You must not modify, adapt, or repair equipment without our permission (routine maintenance excepted).

 

10. Loss, Damage & Insurance
  • You are responsible for fire, theft, and accidental damage while equipment is in your possession, until it is signed back in by us.

  • If equipment is stolen or damaged beyond repair, you must pay:

    • the manufacturer’s list price; and

    • hire charges until settlement.

  • We recommend you ensure your insurance covers these responsibilities.

 

11. Deposits
  • We may require a deposit before hire.

  • Deposits will be refunded once equipment is returned clean, undamaged, and in good working order, less any outstanding charges.

 

12. Hire Charges
  • Charges are agreed in advance (daily or weekly rates).

  • Hire charges apply from the day equipment is collected/delivered until it is returned or confirmed off hire.

  • Weekly rates are charged as seven days.

  • Late returns will incur additional charges.

  • Late payments accrue interest at 4% above the Bank of England base rate.

 

13. Ending the Contract
  • You may end the hire at any time by returning equipment or notifying us it is off hire (for collection).

  • We may end the hire at any time by giving seven days’ notice, or immediately in cases of non-payment, breach of contract, or insolvency.

  • If you fail to return equipment, we may repossess it and charge reasonable recovery costs.

 

14. Liability
  • Our liability is limited to three times the hire charges paid (or due) at the time of the event.

  • We are not liable for loss of profit, revenue, goodwill, business, expected savings, or indirect losses.

  • We are not permitted to limit liability for death or personal injury caused by our negligence.

 

15. Sale of Equipment & Consumables
  • If we sell equipment or consumables, title passes to you only once payment is received in full.

  • Risk transfers upon delivery.

  • Our liability for sales is limited to the price paid.

 

16. Hire as a Consumer

For private/domestic customers only:

  • We acknowledge you may not have specialist knowledge and will provide guidance as required.

  • You must follow all safety instructions and use equipment responsibly.

  • If equipment is stolen or damaged beyond repair, you are liable for replacement costs but not ongoing hire charges after reporting the loss.

  • You should check your insurance cover or request insurance through us (an excess may apply).

  • Liability limits in section 14 do not apply to consumers.

  • Equipment may not be hired for more than three months under this agreement.

 

Governing Law

These Terms of Hire are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
